Terms & Conditions
The following terms and conditions apply to the sale of products listed on the website store of The Medical Shop (TMS), a division of Progressive Medical Corporation (PMC). By placing an order, you agree to be bound by these terms and conditions.
- Order Acceptance: TMS/PMC reserves the right to accept or reject any orders placed on the website store, at its sole discretion. If your order is accepted, you will receive a confirmation email with the details of your order and the payment procedure. If your order is rejected, you will be notified by email and any payment made will be refunded.
- Product
Availability: The availability of the products on the website store is
subject to change without prior notice. TMS/PMC does not guarantee that
the products you order will be in stock at the time of your order. If any
product you order is out of stock, TMS/PMC will inform you by email and
give you the option to cancel your order or wait for the product to be
restocked.
- Pricing: All prices indicated on the website store are ex-works and exclusive of any taxes, fees, or charges that may apply. TMS/PMC reserves the right to change the prices of the products at any time without prior notice. The prices of the products you order will be based on the prices shown on the website store at the time of your order confirmation.
- Payment: Payment for your order must be made through a validated credit card or a validated online deposit to our nominated account shown in the cart checkout. Your order will not be processed until we receive full payment from you. You are responsible for any fees or charges that may apply to your payment method.
- Delivery: All orders are deemed ex-works for pick-up from our store, unless otherwise system-calculated prepaid freight is included in your order payment. If freight is included, we will arrange for the delivery of your order through our third-party delivery partners to the address you provide. Delivery times may vary depending on the availability of the products, the location of the delivery address, and other factors beyond our control. We are not liable for any loss or damage of goods during transit or any delays in delivery. You are responsible for inspecting the goods upon delivery and reporting any defects or discrepancies to us within two (2) days of receipt.
- Warranty: TMS/PMC warrants that its products are free from inherent factory defects according to factory/manufacturer’s warranty clause. This warranty does not cover any defects or damages caused by misuse, abuse, negligence, alteration, modification, improper installation, improper maintenance, or normal wear and tear. This warranty also does not cover any expenses incurred as a result of the purchase and use of the products, such as procedure costs, installation costs, service fees, transportation costs, or consequential damages. TMS/PMC is not responsible for the performance or suitability of the products for any particular purpose or application. You are responsible for determining whether the products meet your needs and expectations before purchasing them.
- Warranty Claims: If you wish to make a warranty claim, you must contact us within seven (7) days of purchase and provide proof of purchase and a description of the defect. We will evaluate your claim and decide whether to replace or refund the product at our discretion. You may be required to return the defective product to us at your own expense for inspection and verification. We will not accept any warranty claims after seven (7) days of purchase or without proof of purchase.
- Returns and Refunds: If you are not satisfied with your purchase, you may return it to us within two (2) days of receipt for a refund, subject to our approval and conditions. You must contact us before returning any product and obtain a return authorization number from us. You must return the product in its original packaging, unused, undamaged, and with all accessories and manuals included. You must also provide proof of purchase and a reason for return. You are responsible for paying for the shipping costs of returning the product to us. We reserve the right to charge a restocking fee of 10% of the product price or refuse a refund if we find that the product has been used, damaged, altered, modified, or missing any parts or accessories.
- Governing Law: These terms and conditions and your purchase of our products shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of laws principles. Any legal action or proceeding arising from or relating to these terms and conditions or your purchase of our products shall be brought exclusively in the courts of Pasig City and you consent to the personal jurisdiction and venue of such courts.
